Immigration Court Quest.?
So here’s my story; my parents are illegal immigrants, they came here illegally roughly 19 (or so) years ago. Then I was born on Dec. 1, 1991 as a U.S. citizen. I have a younger brother and a younger sister who are also American, I have an older sister (about 29 years old) who also came here illegally with my parents. She is now married and legal.
I think it was in 2005 when my parents had to go to court, I am not very clear as to what was said there (it’s been a while and didn’t know at the time what was going on). But they weren’t deported, I think my older sister had to "petition" for my parents. But they weren’t granted citizenship. They did, however, get their "work permits (visas?)" to legally work here; which happened a couple months ago not in 2005.
4 years later, and my parents have another immigration court date next year January. I am in college now (freshman), my siblings are doing very well in school (A’s, B’s, honor roll, etc.) I’ll be 18 years old next week.
With that said, ever since then I’ve been worried for my parents; "Will we be here next year?" "Will they get deported?" … questions that no child should be asking themselves, better yet, have to worry about.
But anyway, I’ve been praying and hoping that one day this burden will be lifted of our backs.
I just hope that on that court date, we get the news we need.
Anyway, my question’s:
What will happen at court?
There are no plaintiffs or defendants; will the judge base his judgment on personal opinion or what?

You said they were deported in 2005.
When and how did they come back?
If they came back illegally after the deportation then their fate is pretty well sealed. They will be deported again and banned for life.
If they came back legally, with passports and visas, and did not lose their status at any time, and are in status now, there’s nothing to worry about.
The judge will follow the law, not emotions. It would be a real good idea for them to be accompanied by an experienced immigration attorney….. http://www.ailalawyer.org
